FACTORS TO DETERMINE CHILD CUSTODY

In Florida, the Judge has the power to decide with whom the child shall live. Usually, if parents can agree on their own custody arrangements, a Judge will readily approve them. However, the final word on custody always belongs to the Court. Effective July 1, 2023, under Florida Statutes it is presumed that the parents will share the overnights with the child(ren) on an equal or 50/50 basis.

Florida provides for shared parental responsibility. Another way to look at this is as joint legal custody where both parents share responsibility for the child and make major decisions affecting the health, education and welfare of the child jointly. Effective October 1, 2008, Florida Statutes no longer uses the terminology of primary physical residence. Now, the parties have a parenting and timesharing plan. Both parents still participate jointly in decision making which affects the child's health, education and welfare.

A Judge has the discretion to limit a parent's timesharing. The court may also require sole parental responsibility if that parent has been guilty of child abuse, or other situations that could cause harm to the child. The ultimate goal of the Court is to have a custody agreement in the best interest of the child.
