Understanding the Legal Process of Divorce in Florida
In Florida, divorce is called dissolution of marriage. In order to get divorced in Florida one party must be a Florida resident for six months before the filing of a divorce petition. The actual process of obtaining a divorce begins with the filing of a petition for dissolution of marriage in the state court of the county where one or both of you reside.
The goal of the legal process of divorce is to end the marriage. Florida is considered a "no fault" state, which means that a person who wants a divorce from his or her spouse does not have to prove that the divorce is due to misconduct or fault of the other party. A no fault may also mean that the Court is not concerned with the facts leading up to the divorce and generally will not consider either spouse's misconduct or infidelity in determining the division of the marital assets.
